We reserve the right to change the general terms and conditions and the returns policy at any time. Any changes to the general terms and conditions will be effective for all new orders placed after the change is published on the Site website.   1. Information about the Site and the goods

By using the website (even if you do not buy any goods) you also agree to be bound by these terms and conditions.

We try to make sure that all information on the Site website, including descriptions of our goods and listed prices, are accurate and correct at all times. However, mistakes do happen. We will try to resolve all errors in information on the Site website as soon as reasonably possible and if we think that such an error has affected your order we will try to let you know.

You should bear in mind that buying goods over the internet provides a different shopping experience from buying in-store. In particular you should be aware that:

  1. The colors of goods as shown on the website will depend on many factors – including your display settings;

  2. The sizes and shapes of the goods may differ in real life from how they appear on your screen. We provide dimensions and measurements in the descriptions of the goods and it is your responsibility to check that the actual size of each item is suitable for your purpose;

  3. Pictures and images on the website are for illustration purposes only. For an accurate description of any item and details of what is included with the item, you need to read the corresponding written description;

  4. All goods are subject to availability and we may not be able to supply your order. We reserve the right to withdraw any goods from sale at any time, and our only liability to you for withdrawing any goods will be to refund to you any money paid to us in respect of those goods which we are no longer able to supply.

We will do our best to check the website for viruses but we do not warrant that the website is free of viruses or other malicious content. For your own benefit, you should make sure that you have appropriate software and systems in place to check for viruses and other malicious content on the internet.

  1. Security

It is your responsibility to ensure that your login details, password and all other details in relation to your account remain confidential at all times. You agree to let us know as soon as possible if you know or reasonably suspect that the security of your account is at risk. 

  1. Availability 

We have the right at any time to modify or stop providing the Site and to stop selling any or all goods through it, either temporarily or permanently and with or without notice. We shall not be liable to you for any modification, suspension or discontinuance of availability of the Site.

4. Eligibility to order goods

You may only purchase from the Site if you are aged 18 years or over. You will need an active email address and a telephone number at which you can be easily contacted.

5. Placing your order 

Your order constitutes an offer to purchase goods from us. Where you order more than one item your order comprises a series of offers for each item individually.

Our order acknowledgement webpage and email set out the final details of your order which you have submitted to the Site. Please take care when placing your order, as you will be unable to add to or amend your order after we send the Order Acknowledgement email.

The order acknowledgement contains details of the goods you have ordered, the total cost of the order including delivery, and an order number. The order acknowledgement email also constitutes the VAT receipt for your goods. You should print off a copy of the Order Acknowledgment email, and a copy of these general terms and conditions and the returns policy and keep them safe.

Please note that the Order Acknowledgement is simply an acknowledgement that your order has been received by the Site; it does not indicate that we have accepted your order and does not form a binding contract.

6. Order Acceptance

Except as set out in paragraph below, acceptance of your order will take place only when we dispatch the goods to you. Until we dispatch your goods no contract will have been formed between you and us.

Although we hope to be able to supply all goods ordered, we reserve the right, at our discretion and without the need to give reasons, not to accept any offer at any time before it has been accepted. Should we refuse your order we will notify you as soon as reasonably possible.

7. Payment

We will take payments either from your card at the time you place your order or cash at the point of delivery of the goods.

We will contact you if we have any problems taking payment from the card details you provide during the order process. Taking payment does not mean we have accepted your order and, in the event of us not accepting your order, a full refund will be given as soon as reasonably possible.

8. Pricing

Unless otherwise stated, all prices shown at the Site are inclusive of VAT and other applicable taxes. The prices shown do not include the delivery fee, which will be added to your total order price in accordance with paragraph below.

Except where otherwise set out in these general terms and conditions, the price payable by you for the goods is the price given by the Site at the time you place your order.

In most cases the delivery fee payable by you for your order will be that which is given by the Site at the time you place your order.

Over the amount of EURO 40,00 (Forty Euros) the delivery shall be free and below the amount of EURO 40,00 (Forty Euros) the delivery fee payable by you for your order shall be EURO 2,00 (Two Euros).  Please note that the free delivery is only to ACS branch if you require for them to deliver to your place of work or home then you will incur this extra cost.

9. Pricing Errors

Whilst we try to ensure that all the prices on the Site are accurate, errors may occur. If we discover an error in the price of the goods you have ordered we will inform you as soon as reasonably possible. We will then give you the option of re-confirming your order at the correct price or cancelling.

If you decide to cancel your order after we have informed you of a pricing error and you have already paid for the goods, we will give you a full refund as soon as reasonably possible.

10. Delivery

10.1 Official Courier of XT ESSENTIALS Ltd

The Official Courier of XT ESSENTIALS Ltd is ACS Air Courier Services (Cyprus) Ltd (hereinafter referred to as “ACS”). XT ESSENTIALS Ltd approves and adopts the terms and conditions of ACS in respect to the delivery of your order(s) and such terms will apply whilst using this website.

10.2 About these terms

These are the terms and conditions (the “Delivery Terms”) which apply to the delivery by us to you of goods purchased by you on-line at www.xtessentials.com.

10.3 Delivery Arrangements

Once you have placed your order we are responsible for taking the order to ACS and we shall do so within 2 (two) to 3 (three) business days from the date you place your order. ACS shall then take over the responsibility of notifying you that your order is ready for collection before 16:00 the latest on each business day.

We shall not be liable in respect of any delay in delivery as a result of any act or omission by you.

If you are not personally available to accept delivery, you may appoint a representative to do so in your place. The representative must be an adult capable of receiving delivery on your behalf, and you agree that we will be entitled to rely on the representative’s instructions as if they were your own.

It is your responsibility to examine your goods when you collect them to ensure what you ordered is what you have received. Once the goods have been delivered to you (or your representative), you become the owner of those goods and from that point they will be at your risk. This means you will be liable for any subsequent damage, loss or destruction.

11. Returns and Refund

We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item. We aim to keep the process as simple as possible and these terms do not affect your statutory rights. We will try to attend to all returns as soon as practically possible. 

You have 2 weeks to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging. Your item needs to have the receipt or proof of purchase. 0

Refunds – once we received your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item. If you return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer’s policies. Shipping – you will be responsible for paying for your won shipping costs for returning your item. Shipping costs are nonrefundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

12. Damaged Items

If any of your items have been damaged (whether before or during delivery), you shall notify us of such damage using our telephone line or emails as soon as possible after deliver.

Any damaged items must be retained for inspection at a later dates. Should you dispose of any damaged items before we have had the opportunity to inspect it, then this could affect any claim for a replacement.

Where it is established that we are responsible for damage to a delivered item, we will replace the damaged item or if we are unable to do so, we will reimburse you with the full amount you have paid for the product together with any delivery charges. 

We will not accept responsibility for any items that are damaged during the delivery process to the extent that such damage is your fault.

13. Returning Unwanted or Damaged Items

We will allocate you with a Returns Code which should be included with the package to improve processing of your return.

We may also advise you how to send the item back to us. Occasionally items may have to be picked up by a courier service.

You will be responsible for the returned Products until they reach us.

14. Our Liability

Our entire liability to you under these general terms and conditions shall not exceed the price paid for the goods you have purchased through The Site, provided that we take reasonable care when we deliver the goods to you.

If we fail to comply with the Delivery Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Delivery Terms or our negligence. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into this contract. 

We will not be liable to you for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to your reputation or for any losses that are not reasonably foreseeable by both of us at the time your order is accepted.

Despite the limitations in paragraphs above, we do not in any way limit our liability to you for death, personal injury or fraud.

14.1 Events Beyond Our Reasonable Control 

We will not be responsible for any delay or failure to comply with these general terms and conditions if the delay or failure arises from any event which is beyond our reasonable control. Such events would include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, war, civil unrest, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods.

15. Waiver 

If you breach these general terms and conditions or the returns policy and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach the general terms and conditions or returns policy.

16. Invalidity

In the event that one or more of the terms set out in these general terms and conditions is held to be invalid by a competent authority, the remaining terms shall continue to have effect and you will still be bound by them.

17. Governing Law

The Agreement shall be governed by and construed in accordance with the laws of the Republic of Cyprus. With respect to any proceedings, the parties agree that the courts of the Republic of Cyprus shall have exclusive jurisdiction to determine any proceedings and submit to the jurisdiction of such courts
